JujuFarm is an informational directory that helps users discover and review jujube farms, including details such as location, varieties, organic certification status, pick-your-own availability, and user-submitted reviews. The Service is provided for general informational purposes only and does not constitute professional, agricultural, medical, dietary, or legal advice.
3. Eligibility & Accounts
You must be at least 13 years old to use the Service. If you submit reviews or other content, you represent that you have the legal capacity to enter into these Terms. You are responsible for any activity that occurs in connection with information you submit, and for keeping any contact information you provide accurate and current.
4. User Conduct
You agree not to use the Service to:
- Violate any applicable law, regulation, or third-party right;
- Post content that is false, misleading, defamatory, harassing, hateful, obscene, or that infringes intellectual property or privacy rights;
- Impersonate any person or entity, or misrepresent your affiliation with a farm;
- Post fake, incentivized, or competitor-driven reviews, or otherwise manipulate ratings or listings;
- Upload or transmit viruses, malware, or any code designed to disrupt, damage, or gain unauthorized access to the Service or its data;
- Scrape, harvest, or use automated means to access the Service except as expressly permitted in writing;
- Interfere with or disrupt the Service, servers, or networks connected to the Service.
5. User-Submitted Content
You retain ownership of reviews, photos, comments, farm submissions, and any other content you submit (“User Content”). By submitting User Content, you grant JujuFarm a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to host, store, reproduce, modify, adapt, publish, translate, distribute, and display such User Content in connection with operating, promoting, and improving the Service.
You represent and warrant that you own or have the necessary rights to your User Content and that it does not violate these Terms or any applicable law. We reserve the right, but have no obligation, to review, edit, or remove User Content at our sole discretion.
6. Intellectual Property
The Service, including its design, text, graphics, logos, icons, software, and compilations of farm data, is owned by JujuFarm or its licensors and is protected by copyright, trademark, and other intellectual property laws. Subject to your compliance with these Terms, JujuFarm grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use.
“JujuFarm” and the JujuFarm logo are trademarks of JujuFarm. You may not use them without our prior written consent. All other trademarks are the property of their respective owners.
7. Farms & Third-Party Information
Listings, contact information, hours, certifications, and other details about individual farms are gathered from public sources and from submissions, and may be incomplete, outdated, or inaccurate. JujuFarm does not own, operate, endorse, or guarantee any farm listed in the directory, and is not responsible for any product, service, or interaction provided by a farm. You should independently verify any information that is important to you before visiting or transacting with a farm.
The Service may contain links to third-party websites. We are not responsible for the content, policies, or practices of those sites.
8. Disclaimers
THE SERVICE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AND UNINTERRUPTED OR ERROR-FREE OPERATION. JujuFarm does not warrant that any farm information, review, rating, or other content is accurate, complete, current, or reliable.
Information on the Service is not a substitute for professional medical, dietary, or agricultural advice. Always consult a qualified professional regarding allergies, food safety, or health questions.
9. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, JUJUFARM AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF, OR INABILITY TO USE, THE SERVICE, EVEN IF JUJUFARM HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT WILL JUJUFARM’S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE EXCEED ONE HUNDRED U.S. DOLLARS (US $100). Some jurisdictions do not allow the exclusion or limitation of certain damages; in those jurisdictions, our liability is limited to the maximum extent permitted by law.
10. Indemnification
You agree to defend, indemnify, and hold harmless JujuFarm and its affiliates from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to your User Content, your use of the Service, or your violation of these Terms or any applicable law.
11. Termination
We may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including if we believe you have violated these Terms. Upon termination, the provisions that by their nature should survive (including intellectual property, disclaimers, limitation of liability, indemnification, and governing law) will survive.
12. Governing Law & Disputes
These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-laws principles. You and JujuFarm agree to submit to the exclusive jurisdiction of the state and federal courts located in San Francisco County, California, for the resolution of any disputes arising out of or relating to these Terms or the Service, except that either party may seek injunctive relief in any court of competent jurisdiction.
13. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the “Last updated” date above and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
